US Army Corps of Engineers(USACE), Omaha District, Ft. Carson Dispute Mediation, CO

 

SUMMIT was retained by the US Army Corp of Engineers (USACE), Omaha District to provide independent third party mediation between the Colorado Department of Health and Environment (CDPHE) and the US Army regarding identification of listed investigation derived- and remediation derived-waste.  The long-standing dispute was heading towards litigation, when SUMMIT’s, Dr. Anderson, met with all parties. He reviewed years of Fort Carson-CDPHE correspondence to understand the history and current issues, and made suggestions to remedy the absence of some historical information so that informed decisions could be made.  The result: CDPHE was able to confidently concur with USACE that the majority of the area in dispute should not be classified as listed waste release/disposal sites and the Army was able to proceed with appropriate remediation activities while managing waste in compliance with RCRA. 

Dr. Anderson prepared a Waste Characterization Instruction to facilitate waste analysis and continues to provide consultation to the Army.
